This website and online store are operated by Paula Gómez Furio, trading as FURIOSO mockups (“FURIOSO”, “we”, “us” or “our”).

These Terms of Service govern access to our website and the purchase and use of the digital products available through it.
2. Acceptance of these Terms
By accessing the website, placing an order or downloading a product, you confirm that you have read and accepted these Terms of Service.
You must be at least 18 years old, or otherwise have the legal capacity required to enter into a binding contract. If you purchase on behalf of a company or organisation, you confirm that you are authorised to accept these Terms on its behalf.
The version of these Terms in force when an order is placed will apply to that purchase.
3. Our products
FURIOSO sells downloadable digital mockups, primarily editable Adobe Photoshop PSD files. No physical product will be shipped.
Each product page provides information about the product, which may include its file format, dimensions, resolution, included files, software requirements and available licence options.
You are responsible for checking that your software, equipment and technical knowledge are suitable for using the product before completing your purchase.
Product previews show possible uses of the mockup. Designs, logos, artwork and other presentation elements shown in preview images are not included unless expressly stated on the product page.
Minor differences in colours or appearance may result from different screens, software versions or display settings.
4. Placing an order
To purchase a product, you must:

Select the product and the appropriate licence.

Add it to your cart.

Provide accurate contact and billing information.

Review the order and final price.

Complete payment using an available payment method.

Provide any consent required for the immediate delivery of digital content.
Your order becomes binding when payment has been accepted and an order confirmation has been issued.
You are responsible for providing a valid email address. Please contact us promptly if any information in your order is incorrect.
We may reject or cancel an order where we reasonably suspect fraud, unauthorised payment, misuse of the website, a material pricing error or an inability to supply the product. If payment has already been collected, the corresponding amount will be refunded.
5. Prices, taxes and payment
Prices are displayed in the currency shown on the website. Any applicable taxes and the final amount payable will be shown before you confirm the order.
Prices and promotions may change without notice, but changes will not affect an order that has already been confirmed.
Discount codes and promotional offers are subject to their stated conditions. Unless expressly indicated otherwise, promotions cannot be combined and have no cash value.
Payments are processed securely through Shopify and the payment providers available at checkout. FURIOSO does not directly store complete payment-card details.
6. Digital delivery
After successful payment, the purchased files will normally be made available through the order confirmation page, by email or through the customer account.
Digital delivery may occasionally be delayed by payment verification, technical maintenance or circumstances beyond our reasonable control.
Download links are personal and must not be shared. Reasonable download or security limits may apply.
You are responsible for downloading and keeping a secure backup of your files. We do not guarantee that purchased files will remain available for re-download indefinitely.
If a file is corrupted, incomplete or cannot be accessed, contact info@furiosomockups.com so that we can investigate and provide a working replacement where appropriate.
7. Product licences
Purchasing a product does not transfer ownership of the mockup or its intellectual property rights. It grants you a limited, non-exclusive and non-transferable right to use that product under the licence selected during purchase.

The licence selected on the product page and the full License Policy available at https://www.furiosomockups.com/licenses form part of the purchase contract.
Each licence applies to one purchased mockup. The permitted company size, client work, commercial use and paid advertising rights depend on the licence selected.
The number of users or company size refers to the people who are permitted to access or use the editable source file.
If your intended use exceeds the limits of your licence, you must purchase an appropriate licence upgrade or contact us before using the product.
Restrictions applying to every licence
You may not:

Sell, share, sublicense, distribute or make the original or modified source files available to another person.

Upload the editable source files to a shared library, public server, marketplace, stock platform or file-sharing service.

Use a mockup to create a competing mockup, template, stock asset or other product whose primary value comes from the original FURIOSO file.

Claim ownership or authorship of a FURIOSO mockup.

Remove or bypass technical measures intended to protect the files.

Use the product for unlawful, fraudulent, defamatory or rights-infringing purposes.
Where client work is permitted, you may provide the client with flattened or exported final images. The editable PSD or other source files may not be transferred to the client. A client who needs access to the editable file must obtain an appropriate licence.
8. Intellectual property
All mockups, source files, images, graphics, text, branding, website content and other materials created by FURIOSO are protected by copyright and other intellectual property laws.
Except for the rights expressly granted under the selected licence, all rights remain with FURIOSO or the relevant rights holder.
The FURIOSO name, visual identity and website content may not be reproduced or used in a way that suggests endorsement, partnership or ownership without prior written permission.
9. Refunds and right of withdrawal
Because our products are digital content supplied immediately and cannot be physically returned, purchases are generally final once the download has begun.
Before immediate delivery begins, consumers may be asked to expressly consent to receiving the digital content during the withdrawal period and acknowledge that they will lose their right of withdrawal once the download begins.
Refunds may still be considered in the circumstances described in our Refund Policy, including duplicate charges, materially defective files, products that are materially different from their description or access problems that we cannot resolve.
A change of mind, failure to check software compatibility or lack of the knowledge required to use the product does not normally qualify for a refund after the download has begun.
Nothing in these Terms limits any mandatory rights you may have under applicable consumer law, including remedies for digital content that does not conform to the contract.
10. Customer accounts and security
If you create a customer account, you are responsible for maintaining the confidentiality of your login credentials and for the activity performed through your account.
You must notify us promptly if you suspect unauthorised access to your account or download links.
You may not use another customer’s account, attempt to bypass security measures or interfere with the proper operation of the website.
11. Support and product compatibility
We provide reasonable assistance with accessing purchased files and resolving confirmed technical defects.
Unless expressly stated otherwise, the purchase does not include personalised design work, Photoshop training, file customisation or support for third-party software.
Software and operating systems may change over time. We cannot guarantee indefinite compatibility with future software versions, although this does not affect your statutory rights concerning the product as supplied at the time of purchase.
12. Availability of the website
We aim to keep the website and download services available, but continuous or error-free access cannot be guaranteed.
We may temporarily suspend access for maintenance, security, technical updates or circumstances beyond our control. Where reasonably possible, we will try to minimise disruption to confirmed orders and downloads.
13. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, or any mandatory consumer rights.
FURIOSO is not responsible for losses caused by:

Using a product outside the scope of its licence.

Using incompatible or unsupported software.

Modifications made by the customer or another party.
-
Failure to download or securely back up purchased files.

Unauthorised sharing of accounts or download links.

Events outside our reasonable control.
If you are purchasing as a business, to the extent permitted by law, FURIOSO will not be liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity or loss of data. Our aggregate liability relating to a particular product will not exceed the amount paid for that product.
These business limitations do not apply where prohibited by law or to customers acting as consumers where mandatory consumer protection rules provide otherwise.
14. Third-party services and links
The website may use or link to third-party services, including Shopify, payment providers, analytics services and social networks.
Those services may be governed by their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control.
15. Suspension and termination
We may suspend access to downloads or terminate a licence where there is reasonable evidence of fraud, payment reversal, unauthorised redistribution or a material breach of these Terms or the selected licence.
If a licence is terminated because of a material breach, you must stop using the affected product and delete all editable source files in your possession or control.
Termination does not affect any rights or obligations that arose before termination.
16. Changes to these Terms
We may update these Terms to reflect changes to our business, products, website or applicable law.
Updates will apply from the date they are published. Changes will not alter the licence or contractual terms governing a purchase already completed unless required by law or expressly agreed with the customer.
17. Force majeure
We will not be responsible for delay or failure caused by circumstances beyond our reasonable control, including major technical failures, internet outages, natural disasters, labour disputes, payment-network failures or governmental action.
18. Severability and waiver
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
A failure to enforce a provision on one occasion does not waive the right to enforce it later.
19. Governing law and disputes
These Terms are governed by Spanish law.
If you are a consumer, you retain any mandatory protections provided by the law of your country of residence and may bring a claim before the courts legally available to you.
For purchases made in the course of a business or professional activity, the parties submit to the courts of Valencia, Spain, unless mandatory law requires otherwise.
